Purpose
These terms of use (the « Terms ») set out the conditions for accessing and using the qualité-eau.lu website (the « Site »), published by The CMO.lu S.à r.l.-S (the « Publisher »). Any use of the Site implies full and unreserved acceptance of these Terms.
Access to the service
The Site is freely accessible to any user with Internet access. No account is required to browse the Site. The Publisher endeavours to keep the Site permanently accessible but cannot be held liable for any interruption, unavailability or maintenance, whether scheduled or not.
Informative nature & no warranty
The Site provides official public data (Administration de la gestion de l'eau, via data.public.lu, CC0 licence) for purely informative purposes. This data is provided « as is », without warranty of accuracy, completeness or timeliness. The Site provides no health, medical, technical or legal advice. For any official information, the user is invited to refer to the AGE or to their municipality.
Role as an introduction intermediary
qualité-eau.lu acts solely as an introduction intermediary between private individuals (the « Users ») and professionals or commercial partners (the « Partners »), in particular adoucisseur-eau.lu and osmoseur.lu.
- a.The Publisher is not a party to the contracts concluded between the User and a Partner.
- b.The Publisher does not sell, install or warrant any product or service.
- c.Quotes, prices, services, warranties and after-sales support are solely the responsibility of the Partners.
- d.The Publisher may receive remuneration (referral fee or affiliation) for this introduction.
Links & commercial partners
The Site contains commercial links to the websites of its Partners, in particular adoucisseur-eau.lu and osmoseur.lu. These links are identified by a Partner badge, in accordance with the transparency obligation (DSA art. 26). The Publisher exercises no control over the content of third-party sites and disclaims all liability in their regard.
User responsibilities
The User undertakes to use the Site in accordance with its intended purpose and with the legislation in force. They warrant the accuracy of the information they submit via the quote or contact forms. They refrain from any fraudulent or abusive use, or any use liable to harm the Site, the Publisher or third parties.
Limitation of liability
To the extent permitted by law, the Publisher cannot be held liable for any direct or indirect damage resulting from access to the Site, its use, the use of the data it contains, or the contractual relationships entered into with a Partner. The User remains solely responsible for the decisions they make, in particular regarding household equipment.
Intellectual property
The source data is distributed under the Creative Commons Zero (CC0) licence. All other elements of the Site — editorial texts, design, structure, illustrations and brand — are the exclusive property of the Publisher and protected by copyright. Any reproduction, representation or exploitation without prior authorisation is prohibited.
Personal data
The personal data submitted via the Site is processed under the conditions described in our privacy policy, which forms an integral part of these Terms.
Amendment of the Terms
The Publisher reserves the right to amend these Terms at any time. The applicable version is the one in force on the date the Site is consulted. It is the User's responsibility to consult this page regularly.
Applicable law
These Terms are governed by Luxembourg law. Any dispute relating to their interpretation or performance falls within the exclusive jurisdiction of the courts of the district of Luxembourg.
